Justice delayed is justice denied.I don’t see any hope for a change in this metaphor prevailing in the country from ages. The judicial system of my country is as good or bad as any other system of our civil society. I am really amused to see how these Judges and the judicial mechanism behave and act as the bearers of justice which they rightly are. However, they look corrupted with the power bestowed upon them by the constitution in such a greater deal probably more than what they deserve.

I see my country really over eager to jump into the next league of developed countries.Political leaders and the ever growing middle class is always discussing but unfortunately not so often reaching a consensus in finding out the ways to make this growth, the inclusive growth. The totality and inclusiveness are the words of developing nations but corruption is the only inclusive thing in this country. Our judicial system has also not been spared from the vice of corruption either. Its share is far more in this inclusive corruption than any other government mechanism of our civil society.

Health services is the other sector that really needs a revival in this country and should be the first and foremost priority for the state. However, I do see the staunch comparisons between the judicial services and the health sector. You will get a same feel going to a lower court or to a general ward of a state run hospital. You will not get due attention unless it’s critical. In a state run hospital the desperation of poor is clearly visible. You won’t get a bed if, you are not a fatal case and there is no guarantee that you will get one even if you are dying. The life is handled so casually that most of the times there are no other options than dying and saving the pain. I strongly believe that health sector and judicial system need drastic changes if we really want to take a leap towards the prosperity in totality.

The governing bodies that have been given charge to bring out the changes in the system are more concerned about filling out their pockets rather than designing a road map for the change. Medical Council of India Head was caught taking a bribe from some rich entrepreneur who wanted to open one more medical college where he can make doctors out of kids born to rich parents. Please don’t blame me if I am not hopeful of any change.

The Judicial system is not in a good shape either. The path to justice starts from the lower courts. These courts are the money churning machines .There is a huge amount of the money that goes around everyday in these court chambers between the support staff. The support staff is least bothered about their monthly salaries they get for their job and at the end of the day any body can over hear these guys bickering over how much money they have made in a day. There are different kinds of advocates depending upon the social strata of the clients. If you are not charging hefty money from your clients, there is every chance that judges won’t give you even a chance to speak. The courts and police have a deep nexus and most of the time the judgments passed in these courts are favoring a section, a party or an individual and there is every chance that justice is not unbiased as it should be. A Kashmiri youth was recently acquitted after almost fourteen years on the grounds of insufficient evidence .No questions were asked why this guy had to spent all his youth in a jail if there was no evidence. This incident further proves the kind of biased justice prevalent in our country.

These lower courts and their proceeding are monitored by High courts and Supreme Court subsequently. The appointment of judges is an issue which has been debated for long and irregulations in the appointments is no more a secret. In a country where fair justice is always denied to the poor and oppressed sections of society, these bearers of justice should not be bestowed upon such a great deal of power, they don’t deserve this. A new and energetic political leader can be made to go on corruption charges in days but Justice Dinakaran will be posted to Sikkim at most and will not be shown the door. The authorities monitoring judiciary in this country are making Sikkim their venting ground. A Chief Justice recently got transferred to Sikkim as he was not working according to diktats of state and its agencies. Is Sikkim not part of India or it doesn’t deserve a fair justice. That’s an irresponsible approach towards the change and unfair to Sikkim. Please, don’t blame me if I don’t want to believe in India shining story.

India can never be part of a league of progressive nations unless

  • Every citizen gets an easy access to basic medical services.
  • Every citizen gets a fair and easy access to unbiased justice.

If the citizens of this country don’t have these basic amenities we are no better than a failed nation.
